General Terms and Conditions

These terms and conditions apply to all our offers and transactions. Deviation is only possible insofar as expressly agreed in writing between the parties. Third-party delivery terms and conditions do not bind Aurora Productions, unless confirmed by her in writing. These terms and conditions have been filed with the Chamber of Commerce in Alkmaar under number 37047086.

1. Copyright

All items are subject to copyright; they may not be reproduced in any way whatsoever without prior written permission from Aurora Productions and/or the copyright holder.

2. Offers

Offers, whether oral or written, are entirely without obligation and are only binding if and to the extent that they have been confirmed in writing by Aurora Productions. The Publisher reserves the right to pass on price increases to the customer between the moment of order acceptance and delivery.

3. Delivery

a) The customer is obliged to cooperate in the delivery of the sold items and to actually take receipt of them.

b) Stated delivery times in offers and/or transactions are given in good faith but are not binding on Aurora Productions, unless expressly agreed otherwise in writing.

c) Exceeding deadlines, regardless of the cause, never entitles the Customer to compensation, dissolution of the agreement, or non-performance of obligations related to the agreement, unless the Customer proves that there is intent or gross negligence on the part of Aurora Productions.

d) Goods always travel at the risk of the Customer, whereby the risk passes to the Customer at the time the goods leave Aurora Productions's warehouse.

4. Ownership

a) Delivered goods remain the property of Aurora Productions until full payment has been made by the Customer to her. 

b) Until the moment of full payment, the purchaser is not authorized, without the cooperation or knowledge of Aurora Productions to transfer ownership of the delivered goods to third parties or to encumber them with third-party rights.

5. Complaints

a) The Customer is obliged to inspect the delivered goods immediately upon receipt.

b) Any complaints must be notified to Aurora Productions in writing within 8 days. Complaints made otherwise or later will only be processed if and to the extent that this has been confirmed in writing by Aurora Productions.

c) In the event of complaints, the Customer is obliged to retain the goods in question and to allow Aurora Productions the opportunity to satisfy itself of the validity of the complaints.

6. Payment of orders on account

a) Payment of orders on account must be made without deduction or set-off within 30 days of the invoice date, failing which the statutory interest applicable at that time will be due plus an amount of € 15.00 in administrative costs (excl. VAT).

b) In the event of non-payment or late payment, all extrajudicial or judicial costs associated with collection shall be borne by the Customer, with a minimum of € 125.00 (excl. VAT) or 15% (excl. VAT) of the outstanding invoice amount.

7. Liability

a) In the event of culpable failure on our part, our liability is limited to either redelivery of the rejected goods or crediting of the shipment, at Aurora Productions' discretion. Any other or further liability is excluded, in particular liability for consequential and/or business losses.

b) The Customer indemnifies Aurora Productions against all claims from third parties regarding damage suffered by these third parties in any form whatsoever in connection with goods supplied by her.

8. Applicable law and disputes

All offers and agreements, as well as related further agreements, are exclusively governed by Dutch law. All disputes arising from offers and/or agreements may be brought exclusively before the competent court in the district of Alkmaar.

9. Use of product data by external platforms

We may make product information, such as product names, descriptions, prices, and images, available to external platforms and AI services, such as search engines and digital assistants, to make our products easier to find.

No personal data is shared in this process. Personal data is processed exclusively as described in this privacy statement and only when this is necessary to fulfill an order or provide our services.

We have no influence on how external parties process or present this information.
